Legal and Dispute Resolution Manager

As legal and ADR manager, you will be an experienced lawyer with both advisory and litigation experience in addition to strong management skills. You will provide expert, solution-focused, strategic and clear legal advice on a range of regulatory and consumer issues within ComReg’s remit – including the implementation and operation of the EU regime governing the relevant sectors.

The role reports to the Director of the Retail and Consumer Services Division and manages a team of legal advisors in the Retail and Consumer Services  Division.  Responsibility for the policy and governance of the alternative dispute resolution processes for consumers of electronic communications and postal services is a key part of the role. The manager will work within a multi-disciplinary environment, which includes business analysts, industry experts, engineers, accountants, economists and other lawyers.

Role Description
Oversee the legal work and alternative dispute resolution responsibilities of the Retail and Consumer Services Division.

  • Manage a team of lawyers and alternative dispute resolution staff in the Retail and Consumer Services Division. This includes setting objectives, leading, coaching, supporting, mentoring and delegating work to the team members.
  • Ensure that compliance standards are adhered to and assist and support the division with relevant advice in the delivery of ComReg’s compliance and enforcement functions.
  • Work with external lawyers to assist and support the division with relevant advice and litigation services.
  • Ensure that consumer alternative dispute resolution policies and processes are fit for purpose and are implemented effectively and in accordance with associated procedures.
  • Undertake consultations as relevant in respect of alternative dispute resolution processes and procedures.
  • Take responsibility for the governance and day to day management of alternative dispute resolution operations and publications.
  • Manage and oversee litigation, as appropriate.
  • Prepare input and associated positions on proposed National or EC legislation impacting ComReg’s responsibilities.
  • Provide clear, concise, practical and strategic legal advice to inform and guide the Retail and Consumer Services Division, the Commission and its staff by identifying the key legal issues, the available options, and the associated legal risks.
  • Review key documentation and identify legal weaknesses and/or necessary changes. Review documentation prepared by staff and external consultants, prior to publication.
  • Draft elements of public consultation documents, regulatory instruments such as decisions, determinations, directions and enforcement measures.
  • Assist the team in ensuring that any proposed regulatory measure is supported by the relevant facts and consistent with applicable law and that the administrative process leading to the proposed measure is properly conducted.
  • As part of the Retail management team responsible for budget, resource, risk assessment and planning for the division’s legal work and dispute resolution responsibilities.
  • Liaise with ComReg’s General Counsel and contribute to organisational best practice and competency

Essential

  • Experienced lawyer enrolled and admitted as a Solicitor or Barrister in the State with a current practising certificate where appropriate
  • 10 years + PQE or demonstrable equivalent experience
  • Legal advisory experience including the analysis and review of complex legal information and issues and the ability to propose solutions regarding the implementation of regulatory policy;
  • Litigation experience particularly in the High Court or District Court (including litigation for/against the State or public bodies, statutory appeal regimes and judicial review);
  • Alternative dispute resolution experience

Desirable

  • Management experience including people management skills and resource planning and budgeting;
  • Experience of advising on EU, regulatory and consumer law as well on public administrative law as it pertains to the electronic communications sector;
  • Experience of advising on or an in-depth understanding of the policies which underpin sector-specific regulation, including market liberalisation and consumer law
