On 21 September 2016, the Commission for Communications Regulation (“ComReg”) published an Information Notice1 providing an update on its review of Eircom Limited’s (“Eir’s”) regulatory governance including, but not limited to, Eir’s Regulatory Governance Model (“RGM”). ComReg appointed KPMG and Cartesian Limited (the “advisors”) as independent advisors to assist ComReg with its review. The review which had two work streams, Governance and Operations, comprised three phases; a Preliminary Phase, Phase 1 and Phase 2.
The Preliminary Phase was completed in May 2016.
Phase 1 is also complete insofar as the advisors have made the draft observations available to ComReg. These draft observations have also been discussed with Eir in order to confirm factual accuracy. The advisors consider that the Phase 1 draft observations were provisional and, as such, were contingent on validation in Phase 2.
Phase 2 commenced in September 2016 and the fieldwork has recently concluded. Phase 2 has entailed a more detailed examination of areas selected based on the draft observations of Phase 1. The advisors have submitted Phase 2 draft reports to ComReg and these are currently being reviewed.
We will follow the same approach as in Phase 1 process to ensure factual accuracy of the draft observations included in the reports. Once this process is complete we plan to publish these reports, subject to the redaction of confidential material in line with ComReg Document No. 05/24. Other Separately, on 14 December 2016 ComReg initiated a competitive tender to set up a contractual framework for possible assistance that may be sought. The following lots were specified:
